DIRECTIONS From the village of Yealmpton, proceed in an easterly direction towards Kingsbridge, bearing left about half a mile past the petrol filling station and head towards Yeo Cottages. On reaching the crossroads proceed straight across and continue for a further half a mile and the entrance to the land will be found on the right hand side.

SITUATION This land at Hall Torrs is situated on the east side of the village of Yealmpton, between Yeo Park and the hamlet of Worston, in the South Hams area of South Devon.

The village of Yealmpton is about three quarters of a mile distant and the A38 dual carriageway expressway, connecting to the M5 motorway and national road network, is about 4 miles to the north.

DESCRIPTION The land at Hall Torrs comprises a total of some 11.50 acres of gently sloping permanent grassland, divided into three lots of varying sizes as approximately shown on the site plan.

The land has in the past been used mainly for livestock grazing purposes but also for grass conservation and has now come available for sale due to it being surplus to the owner's requirements.

The land has a combination of gentle and moderate east, south, north and west facing aspects and whilst it could continue to be used for agricultural purposes, it offers the potential for equestrian, recreational or amenity use, subject to obtaining the necessary planning consent.

FENCING In respect of Lot 1, the boundary marked A - B - C will be fenced by the seller within six months following legal completion with a standard agricultural stock-proof fence. This fence to be owned and maintained thereafter by the purchaser of Lot 1.

In the event that the land is sold as three lots, then the seller will also undertake to supply and install a stock-proof fence within six months following legal completion in relation to :

a) The boundary fences between Lots 1 & 2 and 2 & 3. The fence between Lots 1 & 2 to be owned and maintained thereafter by the purchaser of Lot 2 and the fence between Lots 2 & 3 to be owned and maintained thereafter by the purchaser of Lot 3.

b) The fence against the north boundaries of Lots 2 & 3, these to be owned and maintained by the purchaser of the respective lots in the future.

WATER SUPPLY There is no water supply to Lots 1 or 2, but there is a spring water supply which issues near the east boundary of Lot 3.

In the event that Lots 1, 2 and 3 are sold to separate buyers then the seller will undertake to install a separate metered water supply to Lots 1 and 2 within six months following legal completion or as soon as possible, subject to South West Water regulations and timescales.

ACCESS There is an existing gateway off the council maintained road (as marked on the plan by the letter "G") which leads onto an access strip that will be owned by Lot 3 with Lots 1 and 2 having a right of way over it (for all purposes and all times) to gain access to their respective lots.

Maintenance of this access strip will be shared between the three lots on an equal basis.

TENURE The land is being offered for sale on a freehold basis with vacant possession being available on legal completion.

PUBLIC RIGHTS OF WAY There are no public rights of way through Lots 1 and 2, but there is a public footpath which proceeds through Lot 3 as shown by the dotted line on the site plan.

SPORTING AND MINERAL RIGHTS All sporting and mineral rights are included in the sale as far as are known.

ENVIRONMENTAL STEWARDSHIP The land is not subject to any Environmental or Countryside Stewardship Scheme agreements.

OVERAGE CLAUSE An overage clause will apply in relation to the sale of this property such that 25% of the uplift in value will be paid to the seller (or their successors in title) in the event that planning consent is gained for change of use to residential or commercial. This clause will apply for a period of 25 years from the date of legal completion and this clause will be triggered on the date of planning consent being granted.

METHOD OF SALE The land is being offered for sale by Informal Tender (unless sold prior) with a closing date for tenders being Friday, 22 April 2022 at 12 noon.

Tenders forms are available from the agents and these must be submitted to 62 Fore Street, Kingsbridge in an envelope clearly marked 'Land at Hall Torrs tender'.

The seller does not undertake to accept the highest or any of the offers and the seller reserves the right to withdraw, alter or amend the way in which the land is offered for sale.
